Terms of Service

1. Who we are
Alkemic Ascend is operated by Nextplacement SpA, tax ID 77.229.797-1, registered at Nueva Providencia 1881, oficina 1201, Providencia, Santiago, Chile ("Alkemic", "we", "us").
By creating an account or using the service, you accept these Terms of Service and the Privacy Policy. If you do not agree with them, you must not use the service.
2. What the service is
Alkemic Ascend is an executive career intelligence platform that uses artificial intelligence models to analyse your professional background and generate guidance, diagnostics, positioning materials and interview simulations.
The service is a decision-support tool. It does not constitute professional career, legal, financial or psychological advice, and it does not guarantee employment, interviews or any professional outcome.
3. Eligibility
The service is intended exclusively for people aged 18 or over. By registering, you confirm that you are at least 18 years old. If we find that an account belongs to someone under that age, we will delete it.
4. Your account
- You are responsible for the accuracy of your registration details and for keeping your credentials confidential.
- You are responsible for all activity carried out from your account.
- You must notify us immediately of any unauthorised use.
- You may not share, transfer or resell access to your account.
5. Plans and payments
The service offers a free plan (Free) and a paid plan (Executive) with expanded functionality. The current price of the Executive plan is USD 25 per month. Prices are published on the plans page and may change; any change will be communicated before it affects a renewal.
Payments are processed through Paddle.com Market Ltd, which acts as merchant of record for the transaction. This means the contract of sale is entered into with Paddle, which issues the corresponding receipt and calculates, collects and remits applicable taxes for your jurisdiction. Alkemic Ascend provides the service; Paddle handles the billing.
Subscriptions renew automatically at the end of each monthly period, at the price then in force, until you cancel. You may cancel at any time before the next renewal; cancellation takes effect at the end of the period already paid for, during which you retain access to the plan.
Cancelling your subscription does not delete your account or your data. Account deletion is a separate procedure, described in section 10 and in the Privacy Policy.
The conditions in this section and in section 6 govern from the date of this version. Self-service purchase of the Executive plan is enabled; Alkemic may also activate paid plans manually for selected users, without creating any commitment or acquired right.
6. Refund policy
Right of withdrawal. If you reside in Chile, you have 10 calendar days from purchase to unilaterally terminate the contract, under article 3 bis of Law 19.496 on Consumer Rights Protection. If you reside in the European Union or the United Kingdom, you have 14 calendar days to withdraw. In both cases the refund is in full.
Digital content and immediate access. The service is delivered immediately upon purchase. If you request to begin using it within the withdrawal period, you will be asked for express consent at the time of purchase and will acknowledge that, by doing so, you lose the right of withdrawal in respect of the portion of the service already delivered. Without that express consent, the period remains intact.
Requests outside the period. Outside the periods above, subscriptions are generally non-refundable. We will assess case by case any request based on a service failure that prevented use, a duplicate or incorrect charge, or an inability to access the purchased plan for reasons attributable to us.
Renewals. A renewal charge does not give rise to a refund merely because the service was not used during the period. To avoid renewal, cancel before the billing date. Periods already begun are not pro-rated.
How to request one. Write to contact@alkemicascend.com stating the account email and the reason. We will respond within 5 business days. Approved refunds are processed by Paddle to the same payment method used; the time to appear depends on your issuer and is typically 5 to 10 business days. You may also address your request directly to Paddle in its capacity as merchant of record.
7. Content you provide
You retain ownership of all content you upload to the service, including your CV and your assessment responses.
By uploading content, you grant us a limited, non-exclusive, revocable licence to store and process it for the sole purpose of providing the service to you. This licence ends when you delete the content or your account.
You confirm that you have the right to provide the content you upload and that it does not infringe third-party rights.
8. Acceptable use
You agree not to:
- Use the service for unlawful purposes or to infringe the rights of others.
- Upload third-party content without authorisation, or impersonate another person.
- Attempt to access other users' data, circumvent access or subscription controls, or interfere with the security of the service.
- Extract content by automated means, reverse-engineer the service, or use it to train third-party artificial intelligence systems.
- Embed hidden instructions in the content you upload in order to manipulate the behaviour of the artificial intelligence models.
9. Availability and changes
We work to keep the service available, but we do not guarantee uninterrupted availability. We may modify, suspend or discontinue features, giving you reasonable notice where the change is substantial.
10. Termination
Cancelling your subscription and deleting your account are distinct actions. Cancellation ends renewal of the paid plan and returns you to the free plan at the end of the period already paid for; your data is retained. Account deletion permanently removes your access and your personal data.
You may delete your account at any time from the service settings. The procedure, the window during which you may cancel the request, and the deletion timeframes are described in the Privacy Policy.
We may suspend or terminate your account if you breach these Terms, with prior notice except where the severity of the breach or a legal obligation requires immediate action. If termination is due to a cause not attributable to you, we will refund the proportional part of the paid period not used.
11. Limitation of liability
To the maximum extent permitted by applicable law, Alkemic will not be liable for lost profits, lost employment opportunities, or indirect or consequential damages arising from use of the service.
The service is provided "as is". Professional decisions you make based on the information generated are your sole responsibility.
12. Changes to these Terms
We may update these Terms. Each version has an identifier and an effective date. When we publish a new version that substantially affects your rights or obligations, we will ask you to accept it before continuing to use the service, and we will keep a record of which version you accepted and when.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the competent courts of Santiago, Chile, without prejudice to any non-waivable rights granted to you by the law of your country of residence.
